The Dangers of Bus Rollover Accidents

As of August, U.S. roads have seen more bus accident related injuries and deaths than all of 2010. Inclement weather has been the culprit in many crashes. In March, a bus carrying South Korean tourists slid off a road in New Hampshire in wet, foggy conditions. Recently a bus travelling on Interstate 81 in a severe downpour went off the road and fell 70 feet into a gully.
Driver fatigue and distracted driving are also principal concerns. It is believed that the driver in the March 12 accident in the Bronx that killed 15 people was asleep at the wheel when the bus crashed into a median. It is believe that distracted driving contributed to a similar accident two days later that killed two passengers and injured 25. All told, more than 30 people have been killed and 300 injured in 2011 thus far.
A multitude of injuries occur when buses roll over on their sides or complete a full revolution. While they are not as likely to roll over as SUVs or cars with high centers of gravity, buses often fall into ravines when drivers lose control. Rollover accidents expose passengers to serious injuries based on:
Intrusion - This occurs when the force of the crash forces the structure of the bus to fail. If the frame bends inward or the roof collapses, passengers can be crushed or trapped inside.
Ejection - If windows shatter, passengers are also at risk of being ejected. Portions of a person's body may be exposed as the bus rolls over, or the person may be thrown completely from the bus depending on the severity of the accident.
Projection - Passengers may be slammed into seats or other hard surfaces as the violent motion causes them to be thrown about. Passengers may also be hit by other objects inside the by falling luggage.
Bus companies and their drivers owe passengers a duty to use reasonable care in operating (and maintaining) their vehicles. Essentially, they must drive in a manner a reasonable person would follow in safely transporting passengers to their destination. When they breach that duty, passengers can seek compensation for injuries sustained in accidents caused by such a breach.
